These Terms and Conditions of Use are subject to revision or replacement at any time, and such new terms will be effective on posting to this website.

YOUR USE OF THE ICE.RIEDELLSKATES.COM OR ROLLER.RIEDELLSKATES.COM WEBSITES (COLLECTIVELY, THE “SITES”) INDICATES YOUR ACCEPTANCE OF THE FOLLOWING TERMS AND CONDITIONS OF USE.  ANY PRODUCT PURCHASES YOU MAKE ON THE SITES WILL ALSO BE GOVERNED BY THESE TERMS

These Terms & Conditions of Use (Terms of Use) apply to all use of the Sites, which are owned and operated by Riedell Shoes, Inc. (“Riedell”). By using the Sites, you acknowledge that you have read and agree to all then-current Terms of Use. If you do not agree, do not use the Sites. We also reserve the rights to terminate your access and use of the Sites for conduct that violates these Terms of Use, Riedell’s other rights, or is otherwise illegal, harmful or inappropriate.

The Sites are not targeted towards children, and by accessing and using the Sites, you represent and warrant that you are 18 or older, or if younger, that you are using the Sites with the involvement of a parent or guardian.

 

TERMS OF SALE

1.  Pricing; Orders; Taxes

All product prices are shown in U.S. dollars (except where otherwise noted) and taxes, shipping and handling charges are additional.  All items are subject to availability, and Riedell reserves the right to impose quantity limits on any order.  By placing an order on this website you are making an offer to Riedell to purchase products, which is subject to acceptance (or rejection), in whole or in part by Riedell.  If accepted, Riedell will notify you by providing an order confirmation.  All prices are subject to change without notice, and you agree that taxes may be adjusted for compliance and collection from the amount shown on any shopping cart payment screen.

You will be responsible for any applicable sales or use taxes, duties or other governmental taxes or fees payable in connection with your purchase.  Riedell is not required to collect and remit sales or use taxes in all states and jurisdictions. If you do not pay any such taxes or fees in connection with a transaction via the website, you will be responsible for such taxes or fees in the event that they are later determined to be payable, and Riedell reserves the right to collect such taxes or other fees from you at any time.

2.  Errors.

Riedell attempts to be as accurate as possible and to eliminate errors on the website; however, Riedell does not represent or warrant that any product, description, photograph, pricing or other information is accurate, complete, reliable, current or error free.  In the event of any Riedell errors, we reserve the right to correct such error and revise your order accordingly (including charging the correct price) or to carry out the order and refund any amount charged.  Your sole remedy in the event of an error is to return the product and obtain a refund in accordance with the requirements for returns provided in Section 7 below (Returns and Exchanges).

3.  Pre-Orders

We may offer you the ability to pre-order a product before it becomes available.  If you choose to pre-order a product, we will charge you upon check out and your order will ship when the product becomes available.

4.  Out-of-Stock Items

If the color, size or width of a product you would like to purchase is not shown in the relevant drop down box or list of options on the product’s information page, then the color size or width is not available for purchase.  In the event that the specific product that you would like to purchase is unavailable, please check out our website at a later time as Riedell's inventory of products is subject to change.

5.  Shipping & Handling; Export

You agree to pay all shipping and handling charges shown to you at the time you place your order.  Riedell reserves the right to increase, decrease, add or eliminate these charges from time to time, and you agree to check all charges prior to placing an order.  In general, we ship all products by standard ground delivery, unless otherwise directed by you. Shipping and handling charges displayed during the checkout process may or may not reflect actual costs.  All orders placed through the website are shipment contracts, not destination contracts, so the title and risk of loss or damage to all products purchased via the Services will pass to you upon Riedell’s delivery of the products to a transportation carrier.  Any shipping or delivery dates or times shown on the Services are estimates only and actual delivery dates and times may vary.  You agree that you will not obtain or direct shipment of any product purchased through the website for export, or other resale.

6.  Payment; Credit for Refunds

Only valid credit cards and other payment methods acceptable to Riedell may be used to purchase products and services through the website, and all refunds will be credited to same credit card or, in our discretion, other payment method.  By submitting an order through the website, you represent and warrant that you are authorized to use the designated credit card or other payment method and authorize Riedell to charge that card or other payment method for the purchase amount of your order (including taxes, shipping handling and any other amounts described on the website.  When you provide your payment information, you authorize Riedell (or a third party service provider working on our behalf) to process and store your payment and other related information.  In the event that the credit card or other payment method you designate cannot be verified, is invalid, is not otherwise acceptable, Riedell may suspend or cancel your order automatically.  You are responsible for resolving any problem we encounter in order to proceed with your order.

7.  Returns and Exchanges

To return products that you purchased from Riedell, please contact our Customer Service at 1-800-698-6893 within thirty (30) days of your purchase for a return authorization code.

Where a return has been authorized, the unused products that you purchased from Riedell can be returned in their original undamaged packaging to the address provided in your original shipment package within thirty (30) days of purchase.  Please be sure to include a copy of the packing slip included in your original shipment.

If a gift certificate, card, voucher, coupon or payment method other than a credit or debit card was used to pay the original price of the product you purchased, or if the purchased, or if the purchase you made was part of a special offer that is not in effect when you make your return, Riedell may elect to give you a merchandise credit.  After we have received your valid return, Riedell will provide one of the following within a reasonable time: (a) an exchange of merchandise for the item returned; (b) a non-transferable merchandise credit; (c) a non-transferable certificate or gift card; (d) a credit to the credit card or other payment method used to pay for the product; (e) a check, or (f) another remedy that we determine in good faith appropriate in the circumstances.  If you do not comply with any of the above conditions, we reserve the right to refuse the return or exchange, or to impose different or additional conditions, including (without limitation) basing our response on the current sales price.

If you believe a product sold by Riedell has a condition or defect that might make it unsafe, please report this safety concern immediately by using our email form, or by contacting Customer Service by phone at 1-800-698-6893.

8.  Complaints and Legal Notices

All complaints and legal notices should be mailed to Riedell Shoes, Inc., Attn: Legal Department, 122 Cannon River Avenue, Red Wing, Minnesota 55066. If any law requires us to accept legal notification via email, please call 1-800-698-6893 to ask for the address intended for receipt of such notices.  If you are a California resident, the Complaint Assistance Unit of the Division of Consumer Services of the Department of Consumer Affairs may be contacted at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834 or (800) 952-5210.

9.  Limited Warranty

RIEDELL WILL PASS ALONG THE BALANCE OF ANY MANUFACTURER’S STANDARD LIMITED WARRANTY FOR ANY PRODUCT IT SELLS THAT IS SUBJECT TO WARRANTY PROTECTION.  INFORMATION ON THE TERMS AND DURATION OF ANY MANUFACTURER’S LIMITED WARRANTY ARE AVAILABLE ON REQUEST.  RIEDELL EXPRESSLY DISCLAIMS ALL OTHER REPRESENTATIONS, EXPRESS WARRANTIES AND CONDITIONS, AND ANY IMPLIED WARRANTY ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE OR USAGE OF TRADE, AS WELL AS ANY IMPLIED WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR WARRANTY OF FITNESS OF APARTICULAR PURPOSE, WHICH ARE ALSO HEREBY DISCLAIMED.

This warranty gives you specific legal rights, and you may have other rights, which vary from state to state.

10.  Disclaimers

RIEDELL CANNOT GURANTEE AND DOES NOT PROMISE ANY SPECIFIC RESULTS FROM USE OF PRODUCTS PURCHASED FROM US.

11.  Severability

If any provision of these Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall affect the validity and enforceability of any remaining provisions.

Copyrights and Trademarks

The copyrights/trademarks in all material provided on the Sites belong to Riedell.  Except as authorized below, none of this material may be reproduced, copied, distributed, republished, downloaded, displayed, posted or transmitted in any form without Riedell’s prior written consent.

Access

The Sites are intended for your personal use to obtain information on and place orders with Riedell for available products. You may not distribute, exchange, modify, sell, or transmit anything you copy from the Sites, including but not limited to any text, images, audio, and video, for any business, commercial, or public purpose. As long as you comply with the terms of these Terms of Use, Riedell grants you a non-exclusive, non-transferable, limited right to enter, display, and use the Sites. You also agree not to alter, interrupt or attempt to alter or interrupt the operation of the Sites in any way.

Links to Other Sites

Links on the Sites to any third party websites are provided solely as a convenience to you. If you use these links, you will leave the Sites.  Riedell has not reviewed any third-party websites and does not control and is not responsible for any linked websites or their content. Thus, Riedell does not endorse or make any representations about them, or any information, or other products or materials found there, or any results that may be obtained from using them. If you decide to access any of the third party websites linked to the Sites, you do so entirely at your own risk.

Modifications

Product pricing, availability and any other information or feature, as well as these Terms of Use, are subject to change at any time and without notice. Riedell also reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions, or to change the Terms of Use at any time.

Privacy Policy

Riedell’s Privacy Policy applies to the use of the Sites, and its terms are made a part of these Terms of Use by this reference. Riedell’s Privacy Policy authorizes and governs the use of personal information provided by you while using the Sites.

Limitations of Liability

ALL CONTENT AND USE OF THE SITES ARE PROVIDED ON AN “AS IS” BASIS, AND RWS MAKES NO WARRANTY OF ANY KIND, AND HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING, BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NONINFRINGEMENT.

IN NO EVENT WILL RIEDELL OR ANY OTHER SUPPLIERS, OR OTHER THIRD PARTIES BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOST PROFITS, LOST DATA OR BUSINESS INTERRUPTION) ARISING OUT OF THE USE, INABILITY TO USE, OR THE RESULTS OF USE OF THE SITES, ANY WEBSITES LINKED TO THE SITES, OR THE MATERIALS OR INFORMATION CONTAINED AT ANY OR ALL SUCH WEBSITES, WHETHER BASED ON WARRANTY, CONTRACT, TORT OR ANY OTHER LEGAL THEORY AND WHETHER OR NOT RWS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF YOUR USE OF THE MATERIALS, INFORMATION OR SERVICES FROM THESE SITES RESULT IN THE NEED FOR SERVICING, REPAIR OR CORRECTION OF EQUIPMENT OR DATA, YOU ASSUME ALL COSTS THEREOF. APPLICABLE LAW MAY NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THESE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.

User Submissions

Any communication or material, other than your personal information submitted to the Sites by electronic mail or otherwise (and which will be subject to Riedell’s then-current Privacy Policy), is the exclusive property of Riedell and is considered to be non-confidential and non-proprietary. Such a communication may include, without limitation, questions, comments, suggestions and ideas. Riedell shall be free to use them for any purposes whatsoever without restriction or compensation.

Governing Law

These Terms of Use and your relationship with Riedell shall be governed by U.S. federal law, as well as the internal laws of the State of Minnesota, without regard to applicable conflicts of law principles.  Any failure by Riedell to exercise any of its rights hereunder will not constitute a waiver of such right.  Use of the Sites indicates your irrevocable agreement to submit to the personal and exclusive jurisdiction and venue of the applicable state or federal courts located within the State of Minnesota for any disputes or claims regarding these Terms of Use, purchases or other communications or transactions conducted on the Sites, or any other use of the Sites.
